Spencer Sidewalk Repar, Replacement and Construction Grant Program
In 2013, the Spencer City Council created the Spencer Sidewalk Repair, Replacement and Construction Grant Program.
The rules, provisions and requirements of the Sidewalk Grant Program are as follows:
A. Eligible participants are owners of residential real estate in the City of Spencer on which no sidewalk in the public right-of-way paralleling the street has been constructed or where an existing sidewalk in the public right-of-way paralleling the street is in poor or defective condition and requires repair or replacement.
B. An Application for a Sidewalk Grant shall be made in writing on a form provided by the City and filed with the City Clerk, together with an Application for a Sidewalk Construction Permit.
Upon receipt of an Application, the City Public Works Department will determine that the applicant is eligible and grant requirements are satisfied and approve the application and construction permit or explain in eligibility or additional requirements.
C. When a grant applicant property owner has completed repair, replacement or new construction of a sidewalk in accordance with City specifications, the City will make a grant payment to the property owner in an amount determined by multiplying the number of square feet of new sidewalk construction or replacement by the average local cost of a square foot of 3500lb Portland cement concrete as determined by the Public Works Department.
D. Sidewalk grant payments shall be processed for payment monthly following approval of the construction by the public works department.
E. Sidewalk grants shall be made available on a “first come-first served” basis. When the allocated funds have been allocated or expended or on December 31, 2013, whichever first occurs, the Sidewalk Construction and Replacement Grant Program shall end
F. The property owner shall be liable for the payment of all expenses for material, labor and permits relating to the sidewalk construction, repair or replacement. The City assumes no liability to any providers of materials or labor.
G. All issues or disputes arising in connection with the Sidewalk Grant Program shall be resolved in the discretion of the City Public Works Director, subject to the review of the City Manager.
